Introduction
These Terms of Service (the "Terms") govern your access to and use of the website located at freespeed.co and any related features, content, products, and services (collectively, the "Site"), which are owned and operated by Freespeed LLC ("Freespeed," "we," "us," or "our"). Please read these Terms carefully, together with our Privacy Policy and Refund Policy, which are incorporated here by reference. Together they form a legally binding agreement between you and Freespeed.
By accessing or using the Site, or by placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not access or use the Site.
We reserve the right to change or modify these Terms at any time and in our sole discretion. If we make changes, we will post the updated Terms on this page and update the "Last Updated" date above. Your continued use of the Site after any changes become effective constitutes your acceptance of the new Terms.
Eligibility
To access or use the Site or purchase our products, you must either (a) be at least 18 years of age and have the legal capacity to enter into a binding agreement, or (b) be between 13 and 17 years of age and have the express permission and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf. By accessing or using the Site, or by placing an order, you represent and warrant that you meet one of these conditions.
Children under 13. The Site is not intended for children under 13 years of age. If you are under 13, you may not use the Site, submit any information to us, or purchase our products under any circumstances.
Users between 13 and 17. If you are between 13 and 17 years of age, you may use the Site and purchase our products only with the express permission, involvement, and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf and who accepts full responsibility for your use of the Site and our products. By using the Site or placing an order, you represent that you have obtained such permission and supervision.
Notice to parents and guardians. If you permit a minor between the ages of 13 and 17 to use the Site or to use products purchased from us, you agree to these Terms on the minor's behalf, you are responsible for the minor's use of the Site and our products, and you agree to supervise that use. Our products are dietary supplements intended for healthy individuals; a minor should use our products only under the supervision of a parent or guardian and, where appropriate, a qualified healthcare provider.

The information provided on the Site is for informational and educational purposes only and is not intended as medical or healthcare advice, nor as a substitute for professional advice from a qualified healthcare provider. Always seek the advice of your physician or other qualified healthcare provider before taking any dietary supplement or starting any new health regimen, particularly if you are pregnant, nursing, taking medication, have a known medical condition, are under medical supervision, or are under 18 years of age.

Products and Orders
We take reasonable care to describe and display our products accurately. However, we do not warrant that product descriptions, images, or other content on the Site are accurate, complete, reliable, current, or error-free. Product packaging and colors may vary from the images shown.
All orders placed through the Site are offers to purchase and are subject to our acceptance. We reserve the right, in our sole discretion, to refuse, cancel, or limit any order for any reason, including after an order has been confirmed or your payment method has been charged. If we cancel an order after you have been charged, we will issue a refund to your original payment method.
Prices, availability, and product offerings are subject to change at any time without notice. In the event a product is listed at an incorrect price or with incorrect information due to a typographical or other error, we reserve the right to cancel or refuse any order placed for that product, whether or not the order has been confirmed.
Payment
By placing an order, you agree to provide current, complete, and accurate payment and account information. You represent and warrant that you are authorized to use the payment method you provide. You agree to promptly update your account information as needed so that we can complete your transactions and contact you. We reserve the right to cancel your order or suspend your account if we believe you have provided inaccurate, fraudulent, or incomplete payment information.
All prices are listed in U.S. dollars. You are responsible for any applicable sales taxes, which will be calculated and added at checkout where required.
Subscriptions and Automatic Renewal
We offer products that can be purchased through a subscription, which will automatically renew unless cancelled. If you sign up for a subscription, you expressly authorize us to charge your payment method on file the applicable subscription price, plus any applicable taxes, on a recurring basis at the interval selected at the time of purchase, until you cancel.
You may cancel your subscription at any time. To avoid being charged for an upcoming order, you must cancel before that order's processing date. You can cancel online through your account, or by emailing us at contact@freespeed.co. If you signed up online, you may cancel online through your account without any additional steps.
It is your responsibility to manage your subscription, including cancellation. Your failure to cancel before your next billing date will result in a charge for the upcoming subscription period, which is non-refundable except as expressly provided in our Refund Policy. If we make a material change to your subscription price, we will provide you with advance notice as required by applicable law.
Refunds and Guarantee
Our refund and money-back guarantee terms are set out in our Refund Policy, which is incorporated into these Terms by reference. Please review it before placing an order.
Shipping and Risk of Loss
We will use commercially reasonable efforts to ship products within a reasonable time after receiving your order. Any delivery dates or timeframes provided are good-faith estimates and are not guaranteed. Title and risk of loss for products pass to you upon our transfer of the products to the carrier.
No Resale
Our products are sold for your personal use only. You agree not to resell, redistribute, or commercially exploit any product purchased from us. If we determine that you are purchasing products with the intent to resell them or are otherwise using them inappropriately or unlawfully, we may cancel your order, suspend or terminate your account, and pursue any available legal remedies.
Reviews and User Content
The Site may allow you to submit reviews, ratings, comments, photographs, and other content ("User Content"). You retain ownership of your User Content, but by submitting it, you grant Freespeed a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and publicly perform your User Content in any media for any purpose, including marketing and promotional purposes, along with the name and location you submit with it.
You represent and warrant that: (a) you own or control all rights to your User Content; (b) your User Content is accurate; and (c) your User Content does not violate these Terms, any applicable law, or the rights of any third party.
You agree not to submit User Content that is unlawful, defamatory, abusive, obscene, harassing, misleading, infringing, or otherwise objectionable. We have the right, but not the obligation, to monitor, edit, refuse to post, or remove any User Content in our sole discretion. We do not endorse and are not responsible for any User Content.
Acceptable Use
You agree not to use the Site in any way that is unlawful, fraudulent, or harmful, or that could damage, disable, or impair the Site. Without limiting the foregoing, you agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorized access to the Site or its systems; (c) introduce viruses or malicious code; (d) scrape, data-mine, or use automated tools to collect data from the Site without our written consent; (e) reverse engineer any part of the Site; (f) infringe our intellectual property rights or those of others; or (g) interfere with any other user's use of the Site.
Intellectual Property
The Site and its contents, including all text, graphics, logos, images, designs, and other materials, as well as the Freespeed name, logo, and trademarks, are owned by or licensed to Freespeed and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal, non-commercial use only. You may not copy, reproduce, distribute, modify, sell, or otherwise exploit any content from the Site without our prior written consent. All rights not expressly granted are reserved.

The Site may contain links to third-party websites or resources that we do not control. These links are provided for your convenience only and do not constitute an endorsement. We are not responsible for the content, products, or services of any third-party websites, and you access them at your own risk.
Disclaimer of Warranties
EXCEPT AS EXPRESSLY PROVIDED, AND TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. FREESPEED DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PRODUCT WILL MEET YOUR EXPECTATIONS.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL FREESPEED OR ITS OFFICERS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR ANY PRODUCTS, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL FREESPEED'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF THE AMOUNT YOU PAID TO FREESPEED IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100).
Because some jurisdictions do not allow the exclusion or limitation of certain damages, some of the above limitations may not apply to you. Nothing in these Terms excludes or limits our liability for any matter for which it would be unlawful to exclude or limit liability.
Indemnification
You agree to indemnify, defend, and hold harmless Freespeed and its officers, members, employees, and agents from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site, your User Content, your violation of these Terms, or your violation of any applicable law or the rights of any third party. If you are a parent or guardian who has consented to a minor's use of the Site or our products, you agree that this indemnification also applies to that minor's use.
Dispute Resolution; Binding Arbitration; Class Action Waiver
Please read this section carefully, as it affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any products you purchase from us (a "Dispute") will first be addressed through informal good-faith negotiation. Before initiating any formal proceeding, you agree to contact us at contact@freespeed.co with a written description of the Dispute, and we will attempt to resolve it informally within thirty (30) days.
If the Dispute is not resolved within thirty (30) days, you and Freespeed agree that the Dispute will be resolved exclusively through final and binding individual arbitration, rather than in court, except that either party may bring an individual claim in small claims court if it qualifies. The arbitration will be administered by a recognized arbitration provider under its applicable consumer arbitration rules. This agreement to arbitrate is governed by the Federal Arbitration Act.
YOU AND FREESPEED AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU AND FREESPEED EACH WAIVE THE RIGHT TO A TRIAL BY JURY.
If any portion of this section is found to be unenforceable, the remainder will continue to apply, except that if the class action waiver is found unenforceable, then this entire arbitration section will be null and void.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of laws principles. Subject to the arbitration provisions above, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction of those courts.
Termination
We may suspend or terminate your access to the Site at any time, in our sole discretion and without notice, including if we believe you have violated these Terms. Provisions that by their nature should survive termination will survive, including intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution.
Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed, and the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Freespeed regarding your use of the Site and supersede any prior agreements. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
